FOUL PLAY: WA Senator Sue Lines reveals lasting impacts of being juror in Kendal ‘Tiny’ Pinder’s trial

The air was stifling inside the packed Supreme Court room on the first day of former Perth Wildcats star Kendal “Tiny” Pinder’s trial. It was his third in 14 months. The journalists present stirred with anticipation and Pinder’s supporters shifted tensely in their seats, while his large legal team shuffled their papers. Pinder, however, appeared nonchalant. His expression impassive, his 6ft 8in frame slouched in his seat. On that unusually hot April day in 1993, the disgraced basketballer seemed as cool as ever. It was something one of the jurors found particularly unnerving, especially for someone facing sexual assault charges against a teenage girl. That juror was Sue Lines, now a Labor Senator for WA. “He didn’t seem to acknowledge the charges that . . . were levelled against him,” Senator Lines said. “It was almost if he was not there.” She said Pinder maintained that expression as the young woman sobbed through her evidence, while his defence lawyers tore her apart on the stand. Senator Lines decided to speak out about her experience of the harrowing trial for the first time in a sit-down interview with The West Australian — and tell her own survivor’s story to encourage others to speak up. “I’d never been a juror before, I’d never been in the Supreme Court before, so all of that was new and it was quite daunting,” she said. Before she was selected, Pinder’s defence lawyer tried to throw her off the jury. The court was told that when Pinder stopped to speak to the victim — a 16-year-old schoolgirl — on May 21, 1988, she saw it as a once-in-a-lifetime chance to chat with a celebrity. It was around 10.30pm, she had just finished her shift at a fast-food restaurant in the city and was waiting for a bus on Barrack Street when he pulled up in his sports car and offered her a lift home. “I thought him, being who he was, it would be all right,” the victim, aged 21 at the time of the trial, told the court. Despite the judge ordering the gallery to be cleared of all “non-essential” personnel while she gave her evidence, Senator Lines counted at least 30 people present. “She seemed very small,” Senator Lines recalled. “She spoke really quietly and she cried a lot of the time . . . the defence lawyers were asking her to speak up and to repeat things, which must have been very difficult for her.” Pinder persuaded the girl, who was a virgin, to go back to his unit, and once inside, he forced her into his bedroom and attacked her. “She (had) to tell — in minute detail — all of these incredibly intimate things that were done to her, uninvited by a man that she had looked up to,” Senator Lines said. “I mean, she was in awe of him — he was a Wildcat, he was Tiny Pinder. “She was defenceless and she was living this sexual assault all over again.” This did not stop Pinder’s “barrage of lawyers” from dissecting the victim’s every word for hours, according to Senator Lines. For example, they went over details like how many steps there were to his bedroom several times. “None of that matters at the end of the day,” Senator Lines said. “They were really just trying to make her doubt her own memory of the event. She was absolutely badgered by the defence lawyers. I was in tears listening to her. I dare anyone to sit in that courtroom and to hear the story she told and not to actually cry.” After a three-day trial, the jury found Pinder guilty of sexual penetration and attempted sexual penetration. Senator Lines has often wondered what happened to the woman who bravely stood up against Pinder’s abuse. What she lost. Senator Lines, a survivor of child sexual assault herself, found the judicial experience particularly harrowing. She was just five years old when was sexually abused by her father’s friend. “I’ve never thought about what happened to me from the perspective of if I had gone to the police,” she said. “Twenty years ago, I would never have told you this story. (But) the more you talk about it, the easier it is . . . It doesn’t make the story any easier, but I’m not embarrassed or ashamed to tell that story anymore, because it’s something that someone did to me without my consent.” Senator Lines admits the justice system seemed stacked against the complainant, and while it has come a long way in the past two decades, there is still a lot of work to be done. “I think that we really do need to look at our courtrooms from the perspective of the person who’s making the complaint,” she said. “I guess in that environment, it’s very easy to feel small.” She said improvements needed to be made to not only correct the power imbalance within the courts, but in all aspects of the society, in order to make it easier for survivors to come forward. “When I say to women, this is what happened to me — if we were in a room of 10 women, probably eight others, would’ve had a similar experience,” Senator Lines said. “It’s shocking.” She hopes the findings of the review by Sex Discrimination Commissioner Kate Jenkins will form a big part of improvements in Parliament by the new Federal Government, but admits: “I think we’ve still got a long way to come.” If you or someone you know has experienced sexual assault or violence, please call 1800 RESPECT (1800 737 732) or LIFELINE (1311 14).
