Rio Tinto’s missing capsule found as Government discusses increasing fines for losing radioactive material

A tiny radioactive capsule missing for a week in the WA outback has been found just south of Newman, ending a sprawling search across more than 1400km of road stretching from the Pilbara to Perth. Emergency Services Minister Stephen Dawson revealed the capsule has been discovered around 11am this morning by DFES and nuclear authorities scouring Great Northern Highway for the potentially deadly device. “The search groups have quite literally found the needle in the haystack,” Mr Dawson said. The capsule was found 2m from the roadside just outside of Newman, a short distance from where its trip had started at a Rio Tinto mine site. It was detected by a truck driving at around 70km/h while carrying Commonwealth-supplied equipment that scans for radioactive activity. After the truck alerted authorities to the presence of radiation, smaller, more highly-calibrated hand-held devices were used to pinpoint the exact location of the capsule. The Australian Defence Force has now verified the capsule using its serial number and a 20m “hot zone” has been established around where it was found, although Chief Health Officer Andy Robertson said the area was unlikely to have suffered any kind of lasting contamination. “It is remote enough that it’s not in any major community. So it is unlikely that anybody has been exposed to the capsule,” he added. The capsule has been placed in a lead-lined box and will be stored in Newman overnight before being transported to a WA Health facility in Perth tomorrow. The 8mm long capsule containing caesium-137 was being transported inside a radiation gauge from a Rio Tinto mine site in the Pilbara to Perth when it appears to have shaken loose from the tool, dropped through a hole in the box it was being carried inside and then fallen off the back of a truck. Dr Robertson — who is also chair of the WA Radiological Council — has launched an investigation into the preparation and transport of the gauge and said a prosecution would flow if any of the requirements of the relevant act had been breached. He acknowledged both the gauge and the box it was inside appeared to have failed “relatively soon after the journey began”. “It will take us at least a few weeks to do that investigation,” Dr Robertson said, adding the probe would include speaking to the manufacturer of the gauge as well as Rio Tinto and the contractors used by the miner to transport the capsule. The final report will be handed to Health Minister Amber-Jade Sanderson. Rio Tinto iron ore chief executive Simon Trott apologised for the loss of the capsule and thanked the State Government for the successful recovery, saying it had been an incredible find by DFES considering the remoteness of the terrain. “Of course, the simple fact that this device should never have been lost. We’re sorry that that has occurred, and we’re sorry for the concern that has caused within the Western Australian community,” Mr Trott said outside Rio’s headquarters in Perth’s CBD. “As the Chief Health Officer talked about today there will be a full investigation into the circumstances that led to the loss of the capsule and we need to learn from this to make sure we put in place additional controls to make sure this never happens again.” Mr Trott would not be drawn on the details of how the capsule was lost, saying he did not want to pre-empt the investigation, or whether Rio would review its agreements with third-party contractors. “We’ve got to work through that investigation and we will review all matters that led to the loss,” he said. Earlier on Wednesday Ms Sanderson revealed the miniscule $1000 maximum fine for losing dangerous radioactive material in WA was in the process of being overhauled. Speaking at the same press conference, Prime Minister Anthony Albanese said the incident should never have happened and that the current penalty was “ridiculously low”. “But I suspect that it’s ridiculously low because people didn’t think that such an item would be lost,” Mr Albanese said. Ms Sanderson subsequently confirmed she had sought advice from the State’s Chief Health Officer about both ramping up the penalty and allowing the government to recover the costs involved in any future similar incidents involving the loss of radioactive material. Under WA’s current Radiation Safety Regulations Act – which Ms Sanderson said was drafted in the 1970s – the maximum fine for failing to safely store or transport radioactive material is just $1000. Ms Sanderson said authorities had “all but ruled out any sinister motives” and that the capsule’s loss was “probably more a case of incompetence rather than conspiracy”. “How these items are transported needs to be reviewed. “And that, along with the penalties and potential for cost recovery, is one of the things that I’ve asked the Chief Health Officer to report back to me on as quickly as possible.” Asked whether penalties for the loss of radioactive material in WA should be reviewed, Rio Tinto iron ore chief executive Simon Trott said that was a matter for the State Government. Mr Trott said he would be “happy” to reimburse the State Government the costs of the search for the capsule so that taxpayers were not out of pocket. The radiation gauge left the Rio Tinto mine site on January 11 and arrived at a Malaga depot on January 16 – but was not unpacked until January 25, when it was discovered to have come apart during the trip. When the contractor realised the radioactive capsule – which emits 10 times the radiation of a chest x-ray from a distance of one metre – was missing, they informed authorities but it took a further two days for the public to be alerted on January 27. Ms Sanderson said the “working theory” remained that vibrations during the trip caused the capsule to shake free of the gauge, and for a bolt in the box the tool was inside to also come loose and fall out. It is believed the capsule then fell through the bolt hole and off the back of the truck somewhere between Newman and Perth. “There are a lot of questions that remain unanswered,” Ms Sanderson said, adding both the transport company and Rio Tinto – as the contracting company – bore some responsibility. “The important thing from the public’s point of view is we are prioritising locating the item and we do not suspect that there are any sinister motivations.” Liberal Leader Libby Mettam said the current $1000 fine “certainly falls well short of the risk that this material provides”. “The McGowan government must urgently review this misstep when it comes to these penalties,” she said.
